Replace the glitter with the same permanent dye they use in bank robberies and the Fart spray with real dumpster juice.
I've lost packages to porch pirates and I'm in favor of making them think twice about ever grabbing a package again.

What say ye, lawyers? Why can't you show the face of a criminal? We're photographed umpteen times a day. What rights to privacy do we have if we're doing somehting illegal?

It bothers me that they blocked the faces of people. What say ye, lawyers? Why can't you show the face of a criminal? We're photographed umpteen times a day. What rights to privacy do we have if we're doing somehting illegal? Marshall, So far in this country one is not required to suffer any penalty for a crime until and unless one has been found guilty in a court of law. Allowing their faces to be identified would surely be counter to our system.

My expectation is that this guy would not, ultimately, suffer any legal penalty if he were to not have obscured their faces. However, I also think he chose prudence over vengeance and avoided the issue (and any associated legal costs) by doing so anyway. I do wonder about the legalities here. Setting booby traps is illegal in California (and I assume every other state). I assume, given his level of sophistication, he had some manner of legal review before putting this out there.

In the first part of the video he shows a couple stealing something off his porch. He said he showed the video to the cops, and they said they didn't have time to chase after the perps. That, of course bothers me. So putting these videos on youtube is not accusing anybody of anything. There's no criminal proceeding. You're just showing what they did. If it damages their character, then that's their problem.
But I'm sure there's some problems with entrapment. These perps would be living a glitter-free life, if not for the entrapping device.
I'm more disturbed by the fact that there's no law enforcement of the cases where home video shows a real package being stolen. If nothing else, i want these people publicly embarrassed by their actions. Put it up on Youtube. There should be a segment on TV news every night. Zoom in on license plates.

I agree that the obscured faces diminish the likelihood of a lawsuit and therefore would recommend it to a client. As to being a "booby trap" under California law, it likely would not qualify, given the legal definition that you cite: it must be a "device designed to cause great bodily injury." Great stuff!
