Don't go spoiling it by going in to help out your fellow colleagues who are buried under Amazon packages. Or by playing golf (reference to, "A Good Walk Spoiled"). Hey, something I've been meaning to ask: how do you pronounce the name of your county? Since it's originally Polish, but filtered through Midwestern sensibilities, it could be six syllables or one.

Bad day in court yesterday for my former client. Due to Michigan rules of evidence, I was effectively precluded from giving expert witness testimony - the initial work that I did relied on a former colleague's notes and laboratory results, my work to complete the project involved collecting soil samples and having them analyzed at a certified laboratory. I could testify that I collected the soil samples with my own hands, and observed the property with my own eyes, but I could not testify about the laboratory results or my interpretation of them. Because the samples were analyzed at a subcontracted lab, the results are not "personal knowledge" (I would have had to analyze the samples myself for the results to be "personal knowledge"). (This is all in contrast to a 3-hour deposition I gave in January) My client is elderly and is representing herself after her attorney withdrew (it's a little more complicated). After sparse and fractured testimony, and very brief cross-examination, the judge still didn't know what work I had done, and questioned me directly to get a brief description of the project with a lack of detail acceptable to opposing counsel. A disasterous day that I shall endeavor to put out of my mind.

Tamarack, to me the lab results sound like the kind of hearsay that experts are routinely allowed to rely on. I don't understand what the problem was. The fact that I don't understand doesn't mean the judge was wrong.

I saw Kim Richey at HEY NONNY in Arlington Heights last night. Always loved her songs and voice. I talked to her briefly aftwards but forgot to ask her what year her J50 is. Looks like a late 50s.

Maybe out severe drought will end. I opened the window a bit last night so I could sleep to the sound of rain, the gauge this morning said just on tenth of an inch shy of 2 inches, and it's been pouring almost nonstop all day.

I saw Kim Richey at HEY NONNY in Arlington Heights last night. Always loved her songs and voice. I talked to her briefly aftwards but forgot to ask her what year her J50 is. Looks like a late 50s. Very nice. She sang backup on a few of Jason Isbell's songs on Southeastern, which is getting a big 10th anniversary re-release. She joined him on a few different nights at his recent Ryman residency.

I got the impression that the judge was frustrated by this, but the rules of evidence/rules of procedure etc. compelled him to sustain opposing counsel's objections. This issue apparently came up in the morning session, when I arrived to testify in the afternoon, the session began with a lengthy reading and teh judge's interpretation of the rules.
I have a lot of other thoughts about this litigation and the people involved, but I think it is wisest not to post these thoughts on the internet.

A Democratic U.S. Rep from here has made it official -- Dean Phillips is running for prez. He's 54, rich, well spoken and seems to make good sense most of the time. He's also Jewish, from the same family lineage as advice columnists Ann Landers, her sister Abby, and their successors.
Look for him at the NH primary.

We have a bridge here connecting Brooklyn and Queens that spans the Newtown Creek, named after Tadeusz Kościuszko, the Polish general. My parents, who were both native Polish speakers, told me the proper pronunciation is koss-CHOOSH-ko. That second "s" preceding the "z" softens the "z." Maybe in Indiana it's different. That's all I know.
