I've been wondering, what is Sydney Powell up to these days? I haven't heard anything for quite some time. She made a counter-claim against Dominion alleging that Dominion defamed her - by saying she lied about the Dominion voting machines. The court promptly, and correctly, threw out her claim. The court noted that she had to allege that Dominion has improperly used the court system to carry out an improper purpose. Making a claim against her is not improper use of the court system. Once you put an issue to be determined before the court, such as Dominion did, it cannot be defamation. Otherwise, as you might imagine, every civil lawsuit would be defamation by the plaintiff and every criminal case by the government would be defamation. For example, I sue Epaul for breach of contract, claiming that I paid $5,000 for 5 tomato plaints, and, instead he sent me one dead zucchini plant. He counter-claims against me for defamation to his horticulture reputation. He can't do that. I simply made my claim. You can't sue me for making a claim, (unless the court determines that is is a bad faith claim). I am just a small town lawyer. I have only litigated a couple defamation claims in local courts (defamation claims are a pain in the ass!) The point is, all experienced litigators would know that Powell's counterclaim would get tossed. I believe that Powell, despite her many shortcomings, is an experienced litigator. How can she be dumb enough to throw crap into a court case?

I don't care if I've lost 92 different cases in 92 different courts. They were all rigged! They ignored my "facts"! The tomato plants were all alive, but the zucchini plant ate them all up in post and then choked on the last one. I have been cheated like no one else ever has been cheated! The biggest most unfair to me cheat in all of history ever. So, to heck with those dumb crooked cheat courts and their stupid legal principles. I'm taking my case to Facebook! I will have bloggers represent me instead of those pesky "pay me, pay me" lawyers that don't deliver. My followers will trumpet my true facts. I mailed you a hundred tomato plants and that dumb zucchini (a generous beyond measure and totally unappreciated bonus on my part, by the way) ate them all and choked.

Some may remember that President Trump, early on, lambasted the mainstream media. His basic message was that they couldn't be trusted. A big victory by Dominion would probably turn people who now rely on Fox to the internet for their news. I doubt that would be an improvement. There's money to be made by telling people what they want to hear. Someone's going to supply that demand.

I've got news for you, most of us have seen this coming since the Nixon resignation. What would be hilarious at this point is if Fox responded by making Dominion prove that overt cheating did not happen. Funny how sure things in law can turn on a dime. Hey, did y'all hear that Kevin McCarthy is turning all of the 14,000+ hours of the January 6 videotape to Tucker Carlson? Time for popcorn!

Now, by all that is honest and just, I hope congress is soon forced by the courts to make the same material available to whatever news media outfit requests it (if they don't, sensibly, decide to do so on their own).
Not that Tucker isn't a completely fair, worthy, and unimpeachable arbiter of how this 14,000+ hours of material should be edited and released by chosen bits to the public. But. there is a freedom of information and access principle at stake. I expect the further release of these complete recordings, either voluntarily or by court order, will occur. Has to occur.
(even the most ardent on the right understand that this release to Tucker and Tucker only not only reeks, it is a rot at the foundation of what this country is supposed to be about. Good job, McCarthy. You are what both sides and the middle say you are.)

As I see it, the judge, a Trump appointee, found inadequate documentation of Powell's wrongdoing, and therefore declined to prosecute her for "misconduct and violating ethics following her attempts and legal work to have the results of the 2020 election overturned." To avoid an ethics malpractice claim, though helpful in continuing to practice law, it is not something that I would add to my list of credentials or consider a "victory." "Hey, I wasn't found guilty of fraud" is not a reputation builder. It is certainly better than being found guilty, though. Trump's legal team was unsuccessful in their litigation efforts to overturn the election, with nearly all their lawsuits being dismissed or dropped due to a lack of evidence. Peter, I think you are bright. I do not understand why you would go out on a limb for Sidney Powell.
